False and misleading advertising

Advertising can be a great source of information but it can also be used to mislead the unsuspecting consumer. You are protected from false and misleading advertising under the Consumer Affairs and Fair Trading Act and the Australian Consumer Law. Things that a seller cannot do include:

  • mislead or deceive you;
  • make false or misleading claims about goods or services;
  • pass off used goods as new;
  • advertise products with false claims eg: when a celebrity says how good it is;
  • claim that a product has benefits that it doesn't have.
